Financial investigations can take months or even years to conclude. The available evidence may include the contents of computer, servers and phones, social media and email messages, bank statements, tax returns, contracts, and statements from tens if not hundreds of witnesses.
 
Prior to any interview, we will obtain the available pre-interview disclosure of evidence. Generally, the investigating authority will disclose a very limited amount of the information it has available. We have experience of advising clients being interviewed in respect of the largest and most complex fraud investigations and will advise as to whether it is in your interests to respond to questions asked, to exercise your right to silence, or to provide a pre-prepared written statement. In many cases, absent access to all the relevant historical material, which may span years of business records, it will not be possible to provide a comprehensive repose to the investigators. 

We engage in proactive pre-charge representation, assisting clients prior to the interview and throughout the entirety of the investigation, to bring matters to an early and favourable conclusion. 

If you are under investigation or invited to attend a voluntary interview under caution, it is imperative that you exercise your right to independent legal advice at the earliest opportunity. The interview is a critical point of any criminal case. Instructing a strong defence team from the outset is crucial to ensure that your legal position is robustly protected, at all times. Even pre-charge, we may where appropriate instruct specialist Counsel and/or forensic accountants or IT experts to assist and provide guidance and support.
